Constitutional Court orders parties to report back within 14 days

Constitutional Court - The Constitutional Court has today (15 June 2017) ordered that the Minister of Social Development is joined as a party to the proceedings of the court in her personal capacity. The court further ruled that Minister Bathabile Dlamini, SASSA CEO Mr. Thokozani Magwaza as well as erstwhile Social Development Director General Mr. Zane Dangor should within 14 days report to the Court whether they have agreed on a process in terms of Section 38 of the Superior Courts Act 10 of 2013 in order to determine the Minister’s role and responsibility in the establishment and functioning of the work streams referred to in the affidavits filed by all the parties.
Reading out the order, Justice Froneman said that should the parties fail to agree, the Court will issue directions determining the process.
The matter before the court related to the contract with Cash Paymaster Services which the Court has since extended for 12 months until 31 March 2018.
Meanwhile SASSA CEO Mr. Thokozani Magwaza confirmed that the Agency will file a report to the Constitutional Court as previously ordered regarding progress made to phase out the current service provider responsible for the disbursement of social grants.
